United HealthCare settlement proposed
On April 24, 2009, Courts in Hamilton County, Ohio and Boone County, Kentucky granted preliminary approval to a settlement reached between the Academy of Medicine of Cincinnati, Butler County Medical Society, Northern Kentucky Medical Society, and the representative Greater Cincinnati/Northern Kentucky physicians and United HealthCare. The settlement stems from a 2002 lawsuit filed by the Academy of Medicine of Cincinnati and others on behalf of local physicians alleging that four insurers Aetna, Anthem, Humana, and United HealthCare – conspired to keep insurance reimbursements to local physicians at an artificially low rate. United HealthCare is the last of the four to settle. Settlements were previously reached with Humana in October, 2003, with Aetna in December, 2004, and with Anthem in November, 2005. FTC delays “red flags rule” implementation until August 1
AMA resource helps physicians comply
A new resource from the American Medical Association can help physicians incorporate a simple identity theft prevention and detection program into their existing compliance and Health Insurance Portability and Accountability Act security and privacy policies.
The AMA developed this resource, which includes a sample policy, in the wake of Federal Trade Commission (FTC) regulations known as the “red flags rule,” which require certain entities to develop and implement programs to protect consumers from identity theft.
The AMA is continuing its efforts to persuade the FTC that physicians are not “creditors” and therefore should not be subject to the rule.
