Lawsuit update

The $100 million settlement with Humana is being implemented. In recent weeks, various doctors have begun negotiating their new (or attempting to re-negotiate their old) contracts with Humana. Doctors are encouraged to contact Attorney Jean Geoppinger at (513) 621-0267 if they encounter any difficulties.

Discovery is proceeding in the Kentucky litigation. Meanwhile, the remaining defendants' appeal of Judge Bamberger's decision denying their motion to compel arbitration is pending before the Kentucky Court of Appeals. Although fully briefed, no date has yet been set for oral argument.

The Ohio litigation remains on hold, notwithstanding the Court of Appeals' decision in our favor. Defendants filed a motion to certify a conflict to the Ohio Supreme Court, which the Court of Appeals denied. After that, defendants filed an appeal and memorandum in support of jurisdiction in the Ohio Supreme Court, which the plantiffs opposed. This is a discretionary appeal and will only be heard if the Supreme Court agrees to take jurisdiction. The Supreme Court's decision is still pending.
