June Lawsuit update

Kentucky – The Kentucky Court of Appeals has finally set oral arguments on the defendants' appeal of Judge Bamberger's decision denying their motion to compel arbitration. The hearing will be held at 3:00 p.m. on Wednesday, August 11, in the Boone County Justice Center. Meanwhile, the AcademyÕs legal team is continuing to review documents and address document production (or lack thereof) issues with the defendants.

Ohio – The defendants' appeal to the Ohio Supreme Court of the arbitration issue is in the process of being briefed. The defendants and several supporting amicus curiae (friends of the court) filed their briefs last week. The Academy's response is due July 21st.

Meanwhile, in relation to the Managed Care Litigation out of Florida – Our appeal of the approval of the Aetna Settlement is scheduled for oral argument before the Eleventh Circuit Court of Appeals at 9:00 a.m. on Thursday, August 12, in Atlanta, Georgia. The objection was filed on behalf of the interests of area physicians in our local suit against Aetna.
