Lawsuit update December 2, 2002
Oral arguments held November 20 in Ohio Case
Numerous Academy members attended on November 20, 2002, when the Honorable David J. Davis, of the Hamilton Coundy Court of Common Pleas, heard oral arguments on defendants' motions:
- to compel physician plaintiffs to adhere to arbitration clauses in their contracts with insurers or, in the alternative,
- to dismiss the plaintiffs' case.
After hearing arguments by counsel for plaintiffs (the Academy of Medicine, et. al.) and defendants (the insurers), Judge Davis took that matter under advisement and indicated that he would rule within 60 days.
Oral arguments in the Kentucky case are expected to be scheduled in January 2003.
